1. Acceptance of terms

These Terms of Service (“Terms”) govern your access to and use of the TAKKT website and analytics platform (the “Service”) operated by TAKKT GmbH, Possartstr. 9, 81679 Munich, Germany (“TAKKT”, “we”, “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. The Service

TAKKT provides analytics tools for music artists and their labels, bringing performance data from multiple platforms together in a single dashboard. The Service is provided on a business-to-business basis to rights holders and their authorised representatives.

3. Connecting third-party accounts (including TikTok)

The Service lets you connect third-party accounts, such as TikTok, so that TAKKT can display your profile and content performance data inside the dashboard. When you connect an account, you authorise TAKKT to access the data made available by that platform’s API on your behalf, solely to provide the Service to you.

Your use of a connected platform remains subject to that platform’s own terms and policies — for TikTok, the TikTok Terms of Service and Developer Policies. You may disconnect a connected account at any time, which revokes TAKKT’s access to it. We display this data; we do not sell it, and we do not use it for advertising.

4. Your responsibilities

You are responsible for maintaining the confidentiality of your account and for all activity under it. You agree to use the Service only for lawful purposes, to connect only accounts you own or are authorised to manage, and not to attempt to disrupt, reverse engineer, or gain unauthorised access to the Service.

5. Intellectual property

The Service, including its software, design, and content provided by TAKKT, is the property of TAKKT and protected by applicable intellectual property laws. Data belonging to you or to connected platforms remains the property of its respective owners.

6. Disclaimer

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted or error-free, or that data retrieved from third-party platforms will be accurate, complete, or available at all times.

7. Limitation of liability

To the extent permitted by law, TAKKT shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with your use of the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

8. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

9. Governing law

These Terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict-of-law provisions. The place of jurisdiction, to the extent permitted, is Munich, Germany.
